1. Acceptance of Terms

Welcome to ModelHunter.AI. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and ModelHunter.AI ("Company", "we", "us", or "our") governing your access to and use of the ModelHunter.AI platform, API services, website, and all related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Services. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

ModelHunter.AI provides a unified API platform that aggregates access to multiple AI generation models for video, image, and audio content creation. Our Services include but are not limited to: API access for AI model inference, a web-based dashboard for account management, a playground for testing API requests, documentation, and related developer tools.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

3. Account Registration and Security

To access certain features of our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials, including your API keys. You are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, outdated, or incomplete, or if we reasonably believe your account has been compromised.

4. Payment and Billing

ModelHunter.AI operates on a pay-as-you-go pricing model. You will be charged based on your actual API usage according to the pricing published on our website. Prices are listed in US Dollars and are subject to change with notice.

You must maintain a positive account balance to use paid Services. Payments are processed through our third-party payment processor (Stripe). By providing payment information, you authorize us to charge your payment method for all fees incurred.

All payments are non-refundable except as required by applicable law or as explicitly stated in these Terms. Unused account balance may be refunded within 30 days of the initial purchase upon request to our support team.

We reserve the right to suspend your access to the Services if your account has an outstanding balance or if a payment method is declined.

5. API Usage and Rate Limits

Your use of our API is subject to rate limits and usage quotas as described in our documentation. We may adjust these limits at any time to ensure fair use and system stability.

You agree not to exceed the rate limits imposed on your account. Excessive usage that disrupts our Services or affects other users may result in throttling, suspension, or termination of your access.

API keys are for your use only and must not be shared with unauthorized third parties. You are responsible for securing your API keys and for any usage associated with them.

6. Acceptable Use Policy

You agree to use our Services only for lawful purposes and in compliance with these Terms. You shall not use our Services to:

  • Generate, distribute, or store content that violates any applicable law or regulation
  • Create content that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Infringe upon the intellectual property rights, privacy, or other rights of any third party
  • Interfere with or disrupt the integrity or performance of the Services or related systems
  • Attempt to reverse engineer, decompile, or disassemble any aspect of the Services
  • Resell, sublicense, or redistribute access to the Services without prior written consent
  • Engage in any automated use of the system that exceeds reasonable usage patterns or that is designed to circumvent rate limits

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this policy, including removing content, suspending or terminating accounts, and reporting to law enforcement authorities.

7. Intellectual Property

The Services, including all software, APIs, documentation, designs, text, graphics, and other content provided by ModelHunter.AI, are owned by or licensed to us and are protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Services except for the limited right to use the Services as described herein.

ModelHunter.AI, our logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ModelHunter.AI. You must not use such marks without our prior written permission.

8. Generated Content

Content generated through our Services using AI models ("Generated Content") is subject to the terms and licenses of the underlying model providers. We do not claim ownership of Generated Content produced through your use of the Services.

You are solely responsible for your use of Generated Content, including ensuring that such use complies with all applicable laws, regulations, and third-party rights. You acknowledge that AI-generated content may not always be accurate, appropriate, or free of defects.

We reserve the right to remove or restrict access to Generated Content that violates these Terms or applicable law.

9. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

10. Third-Party Services

Our Services integrate with and provide access to third-party AI model providers. Your use of these third-party services through our platform may be subject to additional terms and conditions imposed by those providers.

We are not responsible for the availability, accuracy, or quality of third-party services or content generated by third-party models. We do not endorse and are not liable for any third-party services accessed through our platform.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, secure, or that defects will be corrected. We do not warrant the accuracy, reliability, or completeness of any content generated through the Services.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MODELHUNTER.AI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising out of or relating to these Terms or the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless ModelHunter.AI and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

You may terminate your account at any time by contacting our support team or through the account settings in your dashboard. We may terminate or suspend your account and access to the Services at any time, with or without cause, with or without notice.

Upon termination, your right to use the Services will immediately cease. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

We are not liable to you or any third party for any termination of your access to the Services.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after any changes constitutes your acceptance of the modified Terms.

It is your responsibility to review these Terms periodically. If you do not agree to the modified Terms, you must stop using the Services.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted on an individual basis and not as a class action or representative proceeding.

17. General Provisions

These Terms constitute the entire agreement between you and ModelHunter.AI regarding the use of the Services and supersede all prior agreements and understandings.

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
